Fairlead Audio Visual Terms and Conditions

  • Welcome to Fairlead Audio Visual (“Company,” “we,” “our,” or “us”). These Terms and Conditions govern your use of our services, including event production, audio-visual equipment rental, and any related services provided by Fairlead Audio Visual. By using our services, you agree to the following terms. If you do not agree with these terms, please do not use our services.

  • 1. Services

  • Fairlead Audio Visual provides event production services, including but not limited to audio-visual equipment rental, technical support, event consultation, and on-site event management. The specific services we provide will be detailed in the service agreement for each event.

  • 2. Booking and Payment

  • 2.1 Booking Confirmation

  • All bookings must be confirmed in writing. Upon confirmation, a non-refundable deposit of 50% is required to secure your booking. The remaining balance is due 21 days prior to the event unless otherwise specified.

  • 2.2 Payment Methods
    We accept USD (dollars) in wire transfer or check. Invoices shall be paid to Fairlead by the customer within 30 days of the invoice. Late payments may result in additional fees or service cancellations.

  • 2.3 Changes and Cancellations
    Changes to the event details, including the date, time, or location, must be communicated in writing and may incur additional charges. Cancellations must be made in writing 30 days prior to the event. In the event of cancellation after 30 days, you may be liable for the full cost of the services.

  • 3. Equipment and Liability

  • 3.1 Equipment Use
    All equipment provided by Fairlead Audio Visual is for use during the event and remains the property of the company. Clients are responsible for ensuring that all equipment is used properly and safely. Any damages or losses incurred due to misuse or negligence will be the client’s responsibility.

  • 3.2 Equipment Failure
    Fairlead Audio Visual will ensure that all equipment is in working order before the event. In the unlikely event of equipment failure, we will make reasonable efforts to repair or replace it. However, we are not liable for any delays or disruptions caused by technical issues beyond our control.

  • 4. Event Responsibilities

  • 4.1 Client Responsibilities
    It is the client’s responsibility to provide accurate event details, including venue access, power requirements, and timing. Fairlead Audio Visual is not responsible for delays or complications arising from incomplete or inaccurate information provided by the client.

  • 4.2 On-Site Requirements
    Clients must ensure that the event venue meets all technical and safety requirements for the setup and operation of our equipment. This includes providing adequate space, electrical outlets, and other necessary infrastructure.

  • 5. Force Majeure

  • Fairlead Audio Visual is not liable for failure to fulfill our contractual obligations if the failure is due to unforeseen circumstances beyond our control, including but not limited to natural disasters, strikes, government regulations, or any other events considered "Acts of God."

  • 6. Intellectual Property

  • All content, designs, and materials used or created by Fairlead Audio Visual during the event, including logos, videos, and marketing materials, remain the intellectual property of Fairlead Audio Visual unless otherwise agreed upon in writing.

  • 7. Privacy and Data Protection

  • We are committed to protecting your privacy. Any personal information collected during the course of our services will be handled in accordance with our Privacy Policy. We will not share your information with third parties without your consent, except as required by law.

  • 8. Indemnification

  • You agree to indemnify and hold Fairlead Audio Visual, its officers, employees, and contractors harmless from any claims, damages, or liabilities arising out of your use of our services, including but not limited to damages caused by event attendees, contractors, or third parties.

  • 9. Limitation of Liability

  • Fairlead Audio Visual’s total liability in connection with the services provided shall not exceed the amount paid by the client for the services. We are not liable for any indirect, incidental, or consequential damages arising from the event or the use of our services.

  • 10. Governing Law

  • These Terms and Conditions shall be governed by and construed in accordance with the laws of Illinois, without regard to its conflict of law principles. Any disputes arising from these Terms and Conditions will be resolved in the courts of Illinois.

  • 11. Changes to Terms

  • Fairlead Audio Visual reserves the right to modify these Terms and Conditions at any time. Any changes will be posted on our website, and it is your responsibility to review them periodically.
